Background

The Texas Residential Construction Commission was created in the 2003 session in response to high profile problems in residential construction in Texas. In early 2006, Comptroller Strayhorn issued a report indicating that 86% of complainants to the commission felt their construction defect had not been resolved through the TRCC process.

This bill is exactly the same as HB 3404(79R) which received testimony but did not pass out of the State Affairs committee.

Detailed Commentary

Rep. Farrar stated, in introducing the bill in the 79th, that the bill language:
1) Requires builder membership in Texas Star Builder Program.
2) Establish 3 consumer seats on the TRCC board.
3) Eliminate fees to families filing complaints.
4) Increases licensing fees to builders.
5) Requires builders hold a general liability policy of $500,000.
6) Requires disclosure of the building standards, warranties, and risks of homes sold by licensed builders.

1) Expands the act to cover interior improvements of less than $20,000 value.
2) Prohibits the commission from charging a fee to a homeowner for filing a complaint or receiving an inspection or arbitration.
3) Clarifies the definition of "public members" of the commission board to exclude industry and include citizens "who have consistently shown an interest in consumer protection."
