Background

There are 28 states that currently require some form of voter verified paper trail or paper ballot if Direct Recording Electronic devices are used in voting systems. This is the second legislative attempt to get VVPAT bill for Texas. Aaron Pena's HB166(79) was the first attempt in 2005.

Nationally, Representative Rush Holt's Voter Confidence and Increased Accessibility Act of 2007 will mandate a VVPAT/B as well as mandate random audits and also escrow the vendor's software nationally for more scrutiny. His bill was just filed on 2/6/07. That bill is H.R. 811. Holt's prior bill H.R. 550(109) had hundreds of co-sponsors. Holt's new bill H.R. 811 is expected to pass this session.

(e) A system involving direct recording electronic voting machines that was acquired before January 1, 2008, may be used in an election without meeting the requirements of this section only if: (1) a voter has the option of casting a paper ballot instead of using the machine; ------------ This gives the voting jurisdictions the option of using paper ballots, optical scan machines or a whole mix of options without having to spend the money to buy the printers if they don't want to. It gives the voter the option of demanding a paper ballot as well.
