I believe its actually implied in the [i Health and Safety Code i] definition of cruelty to animals. ([LINK http://tlo2.tlc.state.tx.us/statutes/docs/HS/content/pdf/hs.010.00.000821.00.pdf 10.821 LINK]). But the point of this legislation isn't repeating the prohibition on animal fighting, it's adding the prohibition on cockfight paraphernalia and raising gamecock.

Unless the owners do something cruel to the gamecocks while raising them for export, I don't see why it should be illegal.

Summary

Adds cockfighting, raising and training cocks with the intent that the cock be used in an exhibition of cockfighting, and possession of cockfighting paraphernalia to the penal code.

Background

Cockfighting has been illegal in Texas since 1907./1/ However, the raising of fowl for cockfighting has remained legal, as the birds are exported to areas such as New Mexico and Louisiana where fighting remains legal./2/ This bill ends this provision and adds definitions and language relating to the illegality of cockfighting itself.

Political Context

The Harris County Constable has requested that the legislature broaden penalties relating to cockfighting, as the actual fights are seldom caught as they are occurring./2/
