I believe its actually implied in the [i Health and Safety Code i] definition of cruelty to animals. ([LINK http://tlo2.tlc.state.tx.us/statutes/docs/HS/content/pdf/hs.010.00.000821.00.pdf 10.821 LINK]). But the point of this legislation isn't repeating the prohibition on animal fighting, it's adding the prohibition on cockfight paraphernalia and raising gamecock.

illegal.

Cockfighting has been illegal in Texas since 1907./1/ However, the raising of fowl for cockfighting has remained legal, as the birds are exported to areas such as New Mexico and Louisiana where fighting remains legal./2/ This bill ends this provision and adds definitions and language relating to the illegality of cockfighting itself.Political Context
