Summary

Prohibits peace officers from detaining a person based only on the person's immigration status or nationality, and from inquiring about a person's immigration status if it is not related to a criminal offense.

Background

Many police chiefs are against local enforcement of immigration laws, as this undermines their ability to build the community trust they need to keep the peace. Localities also find the cost of enforcing federal immigration polices burdensome.

This bill is more or less the exact opposite of HB 858

I don't think sanctuary that is the point of this legislation. This language allows the undocumented population to come forward to police if they witness a property or personal violence crime. The benefit accrues to the entire community. There is an analogy here with the IRS's 6103 restriction on sharing tax information with criminal enforcement agencies. The IRS enforce tax law better if filers trust the agency aren’t sharing the information given to them. Here, local police can enforce local law better if a significant portion of the population isn't hiding from them.

I stick by my previous comment. making excuses why not to detain and deport is not the way to go.

People ought not be harrassed by the police because they "look foreign". Ironically, Americans in certain (not all) areas of Mexico are harrassed by the police force because of their nationality, which makes the situation sticky if you are the victim of a crime or witness a crime - this legislation is an effort to counteract that kind of culture in our law enforcement, and ought to be supported.
